5-YEAR LIMITED WARRANTY
For a period of five (5) years from the date of the purchase, the manufacturer (herein “Company”)
warrants to the Original Purchaser (herein Purchaser) that TPF/SSC/PRO—Rollable Event Flooring (herein Product) is free from any defect in workmanship or material.
This 5-Year Limited Warranty is subject to the PortaFloor Warranty and the additional Replacement or Repair of Product, Limitations and Exclusions, and Warranty Registration and Claim Procedure provisions set forth below:
TPF/SSC/PRO FLOORING WARRANTY
During the five (5) year period covered under this Warranty, the Company will replace or repair any defective Flooring under the following schedule:
0 to 1 Years - No charge to Purchaser.
2 to 5 Years - 60% of List Price (as defined below) to Purchaser.
Note: In addition to the above, for those with a purchase of more than 5,000 sq ft, Company will
replace up to a total of 50 pcs free of charge (other than shipping costs) during the first 5 years, should they be defective.
REPLACEMENT OR REPAIR OF PRODUCT
At its option, the Company may replace or repair any defective Product covered by this Warranty according to the above schedule. For the purposes of this Warranty, List Price shall mean the prevailing retail price as of the date on which any warranty claim is filed with the Company. Purchaser’s refusal or failure to pay its portion of the replacement costs due under this Warranty renders the Warranty void and unenforceable and relieves the Company of any further obligation under this Warranty.
LIMITATIONS AND EXCLUSIONS
TPF/SSC/PRO—Rollable Event Flooring warranties are void and unenforceable if:
a) Purchaser fails to maintain the Product in accordance with approved maintenance procedures; or
b) any Product has been misused or damaged by accident, unreasonable use, abuse, neglect, exposure to petroleum-based products, improper installation, acts of God, or any other cause not directly due to any defect in materials or workmanship of the Product; or
c) if the Product has been exposed to any load in excess of the specifications; or
d) if the Product has been resold to any third party, separately or as a whole; or
e) if the Product has been sold as part of any real property.
NO WARRANTIES EXPRESSED OR IMPLIED ARE MADE BEYOND THE WARRANTIES SET FORTH HEREIN. TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE APPLICABLE TO ANY PRODUCT IS EXCLUDED. CELINA TENT SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY LOST PROFITS OR
WAGES, INCONVENIENCE, COMMERCIAL LOSS, INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES SUFFERED OR SUSTAINED BY PURCHASER.
THE MAXIMUM RESPONSIBILITY OF the Company TO PURCHASER UNDER THIS WARRANTY IS LIMITED TO THE TOTAL PRICE PAID BY PURCHASER TO the Company FOR THE PRODUCT. THE FOREGOING DAMAGE LIMITATION SHALL APPLY REGARDLESS OF WHETHER PURCHASER ASSERTS ANY CLAIM FOR BREACH OF WARRANTY OR CONTRACT, STRICT LIABILITY OR TORTIOUS MISCONDUCT, AND REGARDLESS OF WHETHER the Company HAS BEEN ADVISED OF ANY POTENTIAL FOR DAMAGES TO PURCHASER PRIOR TO ACCRUAL OF ANY CLAIM BY, TO, OR FOR THE BENEFIT OF PURCHASER.
THE FOREGOING WARRANTY MAY NOT BE ASSIGNED OR TRANSFERRED BY THE PURCHASER. THE OBLIGATIONS OF the Company UNDER THIS WARRANTY ARE EXTINGUISHED UPON THE PURCHASER’S TRANSFER OF THE PRODUCT TO ANY THIRD PARTY FOR ANY USE OR PURPOSE. THIS WARRANTY SHALL BE GOVERNED AND INTERPRETED UNDER THE INTERNAL LAWS OF THE STATE OF UTAH WITHOUT REFERENCE TO ANY CHOICE OF LAW OR PROVISION OF ANY OTHER STATE OR JURISDICTION.
Warranty registration is automatic at the time of purchase.
